Who these terms are between

StartAutomate.ai is run by Rajat Kumar and Akshay Malhotra, a remote team based in Dehradun, India, and post reaches us at Plot 30, Green View Estate, Kulhan, Chalang, near IT Park, Sahastradhara Road, Dehradun, Uttarakhand 248013, India. In these terms "we" means the two of us trading together as StartAutomate.ai, and "you" means the person using the site or the business that hires us.

Using this website

You can read the site, listen to the demos, fill in our forms and talk to us in the chat window for any genuine business reason. Please don't try to break into the site, flood the forms with automated submissions, pretend to be someone else, or copy large parts of our content onto another website without asking us first, and if you do, we may block you from using it.

Enquiries and free plan reviews

Sending us a form or booking a free plan review doesn't create a contract, and it doesn't commit you to anything. The plan review really is free, and we will tell you in it if a person or a cheaper tool would suit your business better than an AI agent.

How a project is agreed

Every project starts with a written proposal that sets out what the agent will do, which of your systems it connects to, the price, the payment schedule and the dates, and it becomes a contract when both of us have signed it or you have paid the first invoice. Anything outside that written scope is extra work, and we will quote for it before starting.

Prices and payment

Prices on the website are starting points in US dollars, and your proposal gives the exact figure in your currency, along with any sales tax or VAT that applies. Build projects are paid as a 50% deposit when the proposal is signed and the remaining 50% when the agent goes live, and monthly support plans are billed at the start of each month.

Invoices are due within 14 days. Phone numbers, call minutes and AI usage are charged by other companies, such as the telephony and speech providers named in your proposal, and we either pass those costs to you at the price we pay or set the accounts up in your business's name so the providers bill you directly.

Refunds and cancellations

Our Refund Policy at startautomate.ai/refund-policy explains what you get back if you cancel before we start, partway through a build, or after your agent has gone live, and it forms part of these terms.

What we need from you

You agree to give us accurate information about your business, answer our questions during the build within a reasonable time, and give us access to the calendars, CRMs and phone systems the agent has to work with. If the agent will make outbound calls or send messages, you are responsible for having the consent the law requires for each person on your list, which in the US includes the TCPA and in the UK includes PECR and the TPS register, and for telling us if any of your callers' information is health data.

Limits of an AI agent

AI agents can mishear a caller, misunderstand a question or give an answer that is out of date, so you review and approve the agent's instructions and answers before it goes live, and you can ask us to change them at any time afterwards. We don't set agents up to take card numbers, give medical, legal or financial advice, or make decisions that the law says a person has to make, and every agent we build can pass a call to a member of your team.

Who owns the finished work

Once you have paid in full, you own the agent's instructions, its knowledge base, the recordings and transcripts of your calls, and any content we wrote specifically for your business. We keep ownership of the general tools, templates and methods we use on every project, and we give you a permanent license to use whatever part of them is built into your agent.

Confidentiality

We keep your business information, prices, customer lists and call recordings confidential, and we only share them with the providers who need them to run your agent. We won't name you as a client or quote your results anywhere without your written permission.

Liability

Our total liability to you under a project is limited to the fees you paid us for that project in the 12 months before the claim, and neither of us is liable to the other for lost profits, lost business or other indirect loss. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow to be limited, and if you are a consumer, your statutory rights are not affected.

Ending a project or plan

You can end a monthly plan with 30 days' written notice, and either of us can end a project straight away if the other seriously breaks these terms and hasn't put it right within 14 days of being told. When a project ends, we hand over everything you have paid for, and we delete your data from our systems within 30 days unless the law requires us to keep it.

Governing law

These terms are governed by the law of India, and the courts in Dehradun, Uttarakhand can hear any dispute about them. If you are a consumer, you also keep the protection of the law of the country you live in.

Changes to these terms

We may update these terms, and the date at the top of the page shows when we last did. A change never alters a signed proposal that is already running, unless both of us agree to it in writing.
